1. Purpose & scope
These general terms and conditions of sale (GTC) govern all services offered by the company SARL Chacam (Le 3ème Cercle and L'École du 3ème Cercle):
- event and culinary services on quotation (workshops, team buildings, seminars, receptions, dinners, private hire of the venue), intended primarily for professionals (see Part A);
- online bookings and purchases (cooking classes, dinners with the chef, gift cards and vouchers), intended for individuals (see Part B).
They apply to any order, except for particular conditions agreed in writing and set out in the quotation. Placing an order or confirming a booking constitutes unreserved acceptance of these GTC.
2. Prices
For services on quotation, the prices shown on the website are given for information only and have no contractual value: only the prices set out in the accepted quotation prevail. For online bookings and purchases, the applicable price is the one displayed inclusive of all taxes at the time the order is confirmed. Prices are expressed in euros and include VAT at the rate in force (20% unless a specific rate applies to certain services).
Part A: Services on quotation (companies & events)
3. Quotation & formation of the contract
Every service is the subject of a personalised quotation, free of charge and without commitment, drawn up on the basis of the needs stated by the client (date, number of participants, package, options). The quotation sets out the details of the services, the prices and its period of validity. The contract is deemed formed upon receipt of the accepted quotation (dated and signed, or accepted electronically) and payment of the deposit.
4. Deposit, payment & late payment
The order gives rise to the payment of a deposit of 50% of the total amount inclusive of tax (unless a different amount is stated in the quotation), the balance being due at the latest on the day of the service, unless a payment schedule is provided in the quotation. Payments are made by bank transfer. For professional clients, any late payment automatically gives rise to penalties at the enhanced legal interest rate, as well as a fixed-sum recovery indemnity of €40 (articles L.441-10 and D.441-5 of the French Commercial Code).
5. Number of participants
The final number of participants must be confirmed at the latest 3 working days before the date of the service; it serves as the basis for invoicing and cannot be revised downwards within this period. Any request for change (menu, times, options) must be made in writing and remains subject to feasibility and to a possible price adjustment.
6. Cancellation of a service on quotation
Any cancellation or postponement must be notified in writing. Unless particular conditions in the quotation provide otherwise, the following scale applies to a cancellation by the client, depending on the notice given before the date of the service:
- More than 30 days: the deposit paid is retained by the 3ème Cercle;
- From 30 to 15 days: 50% of the total amount inclusive of tax;
- From 14 to 7 days: 75% of the total amount inclusive of tax;
- Less than 7 days: 100% of the total amount inclusive of tax.
In the event of cancellation by the 3ème Cercle (except in cases of force majeure), the amounts paid are refunded in full, to the exclusion of any other compensation.
Part B: Online bookings & purchases (individuals)
7. Order & online payment
Booking a class or a dinner is done online: the selected seats are held for a few minutes, the time needed to complete payment. Payment is immediate and secured by bank card through our payment provider Stripe. The order is confirmed by the sending of a summary e-mail; seats are definitively allocated once payment has been collected. In the absence of payment, the booking is automatically released. Booking seats for a cooking class is limited to 5 seats per user; for a booking of 6 seats or more, your request must be the subject of a personalised quotation: please contact us at contact@cours-de-cuisine-paris.fr.
8. Gift cards & vouchers
Gift cards and vouchers are valid for one year from their date of purchase and can be used on the classes (individuals) and dinners offered by L'École. They are transferable, embodied in a code, cannot be exchanged for cash and are non-refundable. A partially used amount remains available on the card until it is used up or expires. 9. Right of withdrawal
In accordance with article L.221-28 12° of the French Consumer Code, the 14-day right of withdrawal does not apply to leisure services (classes, workshops, dinners) provided on a specified date or period: a booking for a specific date is therefore firm as soon as it is confirmed.
10. Cancellation or postponement by the customer (classes & dinners)
Any request for cancellation or postponement must be sent to us in writing. For information: a postponement is possible up to 7 working days before the date of the class, subject to seat availability; after this period, the seat remains payable. The customer may make a new booking within a maximum of 3 months from the date of cancellation of the class, provided that the initial validity date of the gift voucher used is greater than or equal to 3 months (maximum 2 postponements possible). A customer who is unable to attend may freely transfer their seat to another person, by informing us beforehand.
11. Cancellation by L'École
A class may be cancelled if the minimum number of participants is not reached, or in the event of force majeure. The customer is informed as soon as possible and is offered, at their choice, a postponement, a credit note (in the form of a gift card) or the full refund of the amounts paid, to the exclusion of any other compensation.
Common provisions
12. Allergies, diets & food safety
The customer undertakes to communicate, when confirming or booking, all the allergies, intolerances and dietary requirements of the participants. In the absence of information provided in due time, the liability of the 3ème Cercle cannot be engaged. Our services are carried out in compliance with the applicable hygiene rules.
13. Customer obligations & conduct of the service
Participants undertake to respect the premises, the equipment and the chef's safety instructions, to wear suitable clothing and to arrive on time: any lateness cannot give rise to an extension or a refund. The customer is responsible for damage caused by the participants placed under their responsibility. The participation of minors takes place under the following conditions: 16 years old minimum and accompanied by an adult.
14. Liability & insurance
The 3ème Cercle is bound by an obligation of means in the performance of its services and declares that it is insured under its professional civil liability. Its liability cannot be engaged in the event of a breach by the customer of their own obligations, nor for indirect damage.
15. Force majeure
The liability of the 3ème Cercle cannot be engaged in the event of non-performance due to an event of force majeure within the meaning of article 1218 of the French Civil Code. The parties will then endeavour to agree on a postponement of the service.
16. Image rights & intellectual property
Photographs or videos may be taken during the services; their use by the 3ème Cercle for communication purposes is subject to the agreement of the persons concerned. The recipes, materials and content provided remain the property of the 3ème Cercle and are reserved for personal use.
17. Personal data
The data collected in connection with the order or the booking is processed in accordance with our privacy policy.
18. Complaints
Any complaint may be sent to yl@3ecercle.fr for companies and to contact@cours-de-cuisine-paris.fr for classes for individuals. In accordance with articles L.612-1 et seq. of the French Consumer Code, a consumer customer (individual) has the right, after a prior written approach that has remained unsuccessful, to have free recourse to a consumer mediator.
19. Governing law & disputes
These GTC are subject to French law. Failing an amicable resolution, any dispute will be brought before the competent French courts; a consumer may in particular refer the matter to the court of their place of residence.
